Fort Plain Man Arrested After Crashing Car In Ditch



On September 25, 2021, the New York State Police in Fonda arrested 40-year-old Joseph M. Labadia of Fort Plain, for Driving While Ability Impaired by Drugs- Prior Conviction (E felony), Aggravated Unlicensed Operation 1st degree (E felony), and Criminal Possession of a Controlled Substance 7th degree (A misdemeanor).

At approximately 12:38 p.m. on Saturday, State Police responded to a car into a ditch on State Route 5 in the town of Mohawk. When a Trooper arrived, they located Labadia in the driver’s seat of the vehicle which was in a ditch off the northern shoulder of the roadway. The Trooper assisted Labadia from the vehicle and observed that he seemed disoriented and had poor coordination. A small quantity of suspected heroin was found in his vehicle.

Labadia was transported to St. Mary’s Hospital for evaluation. He refused to provide a blood sample or to complete an evaluation by a Drug Recognition Expert. Labadia was processed at SP Fonda and arraigned in Canajoharie Town Court. He was remanded to Montgomery County Jail without bail and is due in Mohawk Town Court on September 28, 2021.
